U.S. District Court in False Arrest Case Finds No Probable Cause for Arrest, No "Qualified Immunity" for Police Officers, and No "Judicial Estoppel"
An ex-husband was arrested for violating an Extended Protection Order (EPO) for calling the police for a welfare check of his minor son, who was in the custody of his ex-wife. He later filed a "pro se" civil rights lawsuit against the arresting officers in the U.S. District Court of Nevada, alleging claims for false arrest in violation of his Fourth Amendment rights. The U.S. District Court held there was no violation of the EPO, no probable cause for arrest, no "qualified immunity" for the officers, and no "judicial estoppel".
